A. If the person so served does not abate the nuisance within five (5) days, the city may proceed to abate such nuisance with a minimum expense of the abatement to be not less than fifty dollars ($50.00), and such expense shall be charged and paid by such owner or occupant. A lien for unpaid expenses may be imposed against the affected premises in the manner prescribed by the Illinois municipal code. The cost of preparing and filing such a lien may be added to the cost of abatement.
B. Upon being notified of a third offense, the owner or occupant of the premises will be formally charged in Tazewell County circuit court with a violation of this chapter. Any fine or costs imposed by the court shall be in addition to the cost of abatement. (Ord. 567, 8-23-1999)
