7-4-3: OPEN BURNING:
   A.   No person shall at any time burn any "garbage", "litter", "refuse", or "rubbish" as described in title 8, chapter 3 of this code. Burning is prohibited on city streets, sidewalks or within the public right of way.
   B.   When deemed necessary due to climatic conditions, the Marquette Heights fire department fire chief or his designated appointee shall have the authority to impose temporary bans on all outdoor burning including those fires otherwise authorized by this section. It shall be unlawful for any person, corporation, partnership, association or other entity to burn or cause or allow any materials to burn during the term of a burning ban.
   C.   There are three (3) forms of authorized burning: permitted burning, campfires and yard waste fires. Any authorized burning shall be attended by a responsible adult of the minimum age of eighteen (18) for the duration of the burn. Fire extinguishing equipment such as an approved fire extinguisher, water hose or "5 gallon" water containers must be available and ready for immediate use for the duration of any authorized burning.
   D.   Permitted fires, permitted burning or a bonfire requires a formal written permit issued from the city of Marquette Heights. A permitted fire is not allowed within fifty feet (50') of any structure, including neighboring structures and wooded areas. A permitted fire shall be no larger than five feet by five feet (5' x 5') and burn no longer than three (3) hours. Permitted fires are allowed from sunup until sunset and must be completely extinguished thereafter. Exceptions for permitted fires such as size, duration and location may be allowed provided the burn site has been inspected and approved by the Marquette Heights fire department fire chief or his designated appointee. The permittee shall not thereafter alter the material, duration, volume or location of the permitted fire.
   E.   Campfires including cooking fires, warming fires or recreational fires are allowed where only clean, untreated wood or charcoal is used. A campfire is not allowed within twenty feet (20') of any structure, including neighboring structures and fifty feet (50') of wooded area. A campfire shall be no larger than three feet by three feet (3' x 3'). A minimum area of five feet (5') must be cleared of all combustible material from around the campfire. Campfires are allowed from sunup until legal curfew and must be completely extinguished thereafter.
   F.   Yard waste fires including leaf burning, limb and grass clippings are allowed provided smoke and odor emissions do not create a nuisance of hazardous situation. A yard waste fire is not allowed within twenty feet (20') of any structure, including neighboring structures and fifty feet (50') of wooded area. A yard waste fire is allowed from sunup until sunset and must be completely extinguished thereafter. (Ord. 640, 6-10-2002)
