7-1-8: SUSPENSION OF MEMBER:
The Fire Department is an inherent responsibility and function of the City government 1 . The Mayor, when he deems it in the best interest of the City and to ensure proper and continued fire protection for the City, shall have the right to suspend any member of the Fire Department or deny the use of fire equipment to any member of the Fire Department. The Mayor may demand that the Fire Chief suspend a member and that the Chief convene a hearing according to bylaws of the Fire Department. The Mayor shall have the advice and consent of the City Council Fire Committee on contemplated action. However, the Mayor shall have the right to take any action without committee consent, to ensure proper fire protection for the City. The Mayor shall enter upon the minutes of the next regular City Council meeting, the action taken and reasons therefor. The Council, by majority vote, shall uphold or reverse the action taken.
In the event a Fire Department member is suspended by the Mayor, the Mayor shall set a hearing date of not less than five (5) days nor more than ten (10) days after suspension. If a hearing is not held, the suspension shall be of no effect.
The Hearing Board shall be the City Council Fire Committee who will hear facts and opinions to the cause of the suspension. They shall render a report to the City Council at the next regular meeting, with or without the recommendation. The Council shall vote to uphold or reverse the suspension by majority vote.
