9-6-3: APPLICATION AND FILING FEE:
   A.   Filing Of Application; Fee:
      1.   Every person hereafter desiring to drill, maintain or operate an oil, gas or disposal well or to reenter, maintain, and operate an abandoned well in the city shall file application therefor in writing in the form required by the city clerk, signed by the applicant or his agent authorized to sign the same.
      2.   A filing fee of five thousand dollars ($5,000.00) shall accompany the application. This filing fee is required for all permit applications within the city. If the permit is denied, the city will retain a three hundred fifty dollar ($350.00) processing fee and refund the rest.
      3.   No application shall request a permit to drill more than one well.
   B.   Required Information And Documents:
      1.   Such application shall specify the quarter section, township, range, and the location within the quarter section thereof so as to identify said well location within a particular ten (10) acre tract.
      2.   Such application shall specify all equipment to be utilized in the drilling, operating or maintenance of such well with particularity; and the "mud program", as that term is defined in section 9-6-1 of this chapter, shall be specified and attached in writing thereto, for approval by the city clerk. Such application shall also include a statement of provisions for water for the drilling rig.
      3.   Such application shall include a copy of the approved drilling permit from the Oklahoma corporation commission and a copy of the staking plat.
      4.   Such application shall include the names of the mineral, surface, and lease owners and the written approval of the landowners.
      5.   Such application shall include the name and address of the person within the state of Oklahoma upon whom service of process upon applicant may be made within this state; and in the case of any nonresident person who has no such service agent within this state, there shall be attached to the application the designation of such a service agent resident in Stephens County, Oklahoma, and a consent that service of summons may be made upon such person in any action to enforce any of the obligations of the applicant hereunder.
   C.   Reentry Of Abandoned Well: Applications for reentry of an abandoned well shall provide a statement of the condition of the well, the depth to which the applicant proposes to deepen the well, the proposed casing program to be used in connection with the proposed deepening, and evidence of adequate current showing that the casing strings current pass the same tests that are required in the case of the drilling of an original well.
   D.   Conversion Of Well: No person shall convert any well from natural or primary production to a use for enhanced recovery or disposal without first obtaining a municipal drilling permit. The application shall be in the same form as that required for a permit to drill an original, with modifications as determined by the city administrator. In addition, the application shall include copies of all information supplied to the Oklahoma corporation commission and a copy of the commission's approval of the project. (Ord. 369, 2-26-2002)
