8-5-5: GARBAGE AND REFUSE ACCUMULATIONS; CONTAINER REQUIREMENTS:
   A.   Containers Required; Specifications; Location:
      1.   It shall be the duty of every person, firm or corporation owning, managing, operating, leasing or renting any premises or any place where garbage or rubbish accumulates to provide for, and at all times to maintain in good order and repair, on any said premises, a portable container or containers for refuse which shall be made of galvanized metal or equivalent, not easily corrodible, rodentproof and flyproof, with a tight fitting lid which shall not be removed except when depositing or removing the contents of the receptacle, and with handles on the sides, and of sufficient capacity and in sufficient numbers to accommodate and securely keep all of the garbage and rubbish that may accumulate between collections; provided, that each container shall have a capacity as specified from time to time by the city council. All containers shall be kept clean and free from the accumulation of any substance remaining attached to the inside of the container which would attract flies, mosquitoes or any other insects. All container lids shall be chained or fastened securely at all times to a stationary object.
      2.   All containers and grounds immediately around same shall be kept in a safe and sanitary condition at all times, and kept in suitable racks. (1985 Code § 16-83; amd. 2004 Code)
   B.   Refuse Bundled Or Bagged:
      1.   All ordinary accumulations of rubbish such as tree limbs, paper boxes, scrap lumber, bricks, leaves, grass clippings, etc., which cannot be conveniently placed in the containers required under this chapter shall be gathered together in bundles weighing fifty (50) pounds or less and no item in the bundle shall be longer than four feet (4'). Bundles shall be secured with heavy string, rope, etc., so that the binding will not break if used to pick up the bundle.
      2.   Plastic bags may also be used but must be securely tied at the opening and the contents shall be of a weight and composition so as not to cause the bag to break open when lifted by the top.
      3.   Bundles and bags shall be placed immediately adjacent to a public street or alley and not on the private property side of any fence or other barrier, and shall not be stacked in such a location or manner as to hide or obstruct any utility meter, pole, can, lid, or other device.
      4.   Rubble and rubbish not conforming to this subsection will be handled as outlined elsewhere in this chapter. (Ord. 308, 10-25-1988)
   C.   Removal Of Receptacles After Pick Up: Every person, firm or corporation owning, managing, operating, leasing, or renting any premises or any place where garbage or rubbish accumulates shall remove trash receptacles from their collection location, as specified in subsection A2 of this section, to a storage location not visible from the front of the premises within twelve (12) hours after trash is collected by the city or its authorized representative.
