10-10-3: COMMERCIAL MEDICAL MARIJUANA ESTABLISHMENT BUILDING REGULATIONS:
   A.   Dispensaries must be located in a permanent building and may not be located in a kiosk, trailer, cargo, container, or motor vehicle.
   B.   All commercial medical marijuana grower facilities must be constructed in such a manner that the growing of the medical marijuana plants cannot be seen by the public and cannot be smelled by the public from the public right-of-way.
   C.   All commercial medical marijuana establishments shall meet the standards of any applicable state and local electrical, fire, plumbing, waste, development codes, and building specification codes, including, but not limited to, the codes adopted by the Oklahoma Uniform Building Code Commission.
   D.   All commercial medical marijuana establishment shall meet the standards of any applicable state requirements, including, but not limited to the Oklahoma State Department of Health Regulations, Title 310, Chapter 681, as it may from time to time be amended. All commercial medical marijuana businesses shall pay a fee for the completion of a Certificate of Compliance as set forth by Resolution of the Mayor and Council for the City of Marlow.
   E.   All commercial medical marijuana establishment shall operate in a manner that does not constitute a public nuisance. A public nuisance may be deemed to exist if the commercial establishment produces noise or odor that is detrimental to public health, safety or welfare or interferes with the reasonable enjoyment of life and property.
