§ 50.01 CREATED; COMPOSITION; APPOINTMENT; TERMS OF OFFICE; COMPENSATION OF MEMBERS; FILLING VACANCIES.
   (A)   There is hereby created the Town of Marlinton Water Commission, hereinafter called the Commission. The Commission shall be a public corporate body, with perpetual existence and a common zeal. It shall be known as the Town of Marlinton Water Commission.
   (B)   The Commission shall consist of not less than three nor more than five members, a majority of whom shall constitute a quorum for the transaction of business. Each member shall be a resident and freeholder of the town. Each member shall be appointed by the Town Council and shall serve at the will and pleasure of the Town Council. Membership on the Town Council shall not preclude membership on the Commission. However, if the Commission consists of three or four members then only one member may be a member of Council. If the Commission consists of five members, then two of such members may also be members of Council. The term of the Commission membership of any such member of the Council so appointed shall continue during his or her term as a member of Council and until his or her successor is appointed and qualified. The terms of other appointed members shall be for six years and until their successors shall be appointed and shall qualify. The first Commission membership shall be appointed as follows: one for a term of six years; one for a term of four years; and all others for a term of two years. Such terms shall begin upon the date of appointment and taking the oath of office.
   (C)   The members of the Commission shall receive no compensation for their services but shall be entitled to reimbursement for all reasonable and necessary expenses actually incurred in the performance of their duties. They shall not be personally interested, directly or indirectly, in any contract entered into by the Commission, or hold any remunerative position in connection with the establishment, construction, improvement, extension, development, maintenance or operation of any of the property under their control as members of said Commission.
   (D)   When a vacancy occurs on the Commission by reason of death, resignation, change of qualifications, or due to any other cause, the remaining members of the Commission shall appoint such successor for the remainder of the term so filled.
