§ 130.02 EXCEPTIONS.
   All provisions of W. Va. Code Chapter 61 which are felonies shall be deemed not to have been adopted by the town in § 130.01. All misdemeanors in W. Va. Code Chapter 61 which have a minimum mandatory jail sentence greater than 30 days shall also be deemed not to have been adopted by the town in § 130.01. Any misdemeanor which provides for a possible incarceration time greater than 30 days shall be included in § 130.01, but shall automatically be modified to state that the maximum incarceration time be 30 days. Any provision in W. Va. Code Chapter 61 for which the legislature, the state courts or the Supreme Court of Appeals of the state states that the state has exclusive jurisdiction over the subject matter shall also be deemed not to have been adopted and included in § 130.01. The adoption of W. Va. Code Chapter 61 shall be further limited by any other provision of the West Virginia Code, or by decisions of competent courts in this state which would further limit the jurisdiction of the town in these matters.
