§ 113.02 LICENSE REQUIRED; WHERE LICENSE OBTAINABLE; EXEMPTIONS.
   (A)   It shall be unlawful for any person to establish, operate or maintain any general store or special store in the town without first having obtained a license so to do from the office of the Recorder.
   (B)   The establishment, operation or maintenance of stores by the following shall be exempt from the license tax imposed by this chapter:
      (1)   The United States of America, the State of West Virginia and its political subdivisions;
      (2)   Religious and charitable organizations; and
      (3)   Any person or persons engaged within the town in the business of producing agricultural products, who, individually or collectively, sell in such store only agricultural products which he, she or they have produced.
