§ 94.15 REMOVAL, REPLANTING AND REPLACEMENT.
   (A)   Whenever it is necessary to remove a tree or trees in connection with the paving of a sidewalk, or paving or widening of a portion of a street used for vehicular traffic, the town will replant such trees or replace them. If it is impractical to replant in the same area, the Marlinton Tree Committee will designate an appropriate location for planting the replacement tree or trees.
   (B)   No person or property owner shall remove a tree from the town right-of-way for the purpose of construction, or for any other reason, without prior approval from the Marlinton Tree Committee and must replace the removed tree or trees in accordance with the adopted comprehensive town tree plan. Such replacement shall meet the standards of size, species and placement as provided by the Marlinton Tree Committee. The person or property owner shall bear the cost of removal and replacement of all trees to be removed and replaced.
