(A) Any such facility so constructed, shall be constructed in accordance with the plans, specifications, rules and regulations of the Federal Aviation Administration as well as the West Virginia Aeronautics Commission, and where a conflict may exist between the said agencies, then the rules and regulations as required by the Federal Aviation Administration shall be those adopted by the Town Council for the construction of such a facility.
(B) The town by the authorization of construction of such a facility, in no way obligates itself to the responsible for the construction or operation of such a facility, and that this chapter is merely enacted for the purposes of enabling such agency or agencies as may desire to build such a facility within the corporate limits to so do.
