§ 112.045 UNLAWFUL HOURS OF OPERATION/SALE HOURS.
   (A)   Class A and B licenses.
      (1)   No establishment or licensee issued a Class A license shall be open to the public between the hours of 2:00 a.m. and 8:00 a.m. on Monday through Saturday and 2:00 a.m. and noon on Sunday. A Class B licensee shall not be open between the hours of 12:00 a.m. and 8:00 a.m. on Monday through Saturday and 12:00 a.m. and 11:00 a.m. on Sunday. In addition to being in violation of this code, any establishment issued a Class A or B license found to be operating during the aforementioned prohibited times shall also constitute a public nuisance. The city may take any action authorized by law to abate the nuisance. It is additionally unlawful for a Class A licensee to sell, offer for sale at retail, give away, or otherwise serve or permit the consumption of alcoholic liquor except during the liquor sale hours depicted in § 112.018.
      (2)   No Class A or B licensee shall advertise or promote in any way, whether within or outside of the licensed premises, hours of operations prohibited by this section.
   (B)   Class C to G licenses.
      (1)   It shall be unlawful for a Class C, D, E, F, or G licensee or licensed establishment to sell, offer for sale at retail, give away, or otherwise serve or permit the consumption of alcoholic liquor except during the liquor sale hours depicted in § 112.018.
      (2)   No Class C, D, E, F, or G licensee or licensed establishment shall advertise or promote in any way, whether within or outside of the licensed premises, liquor sale hours prohibited by this section.
   (C)   General prohibitions. It shall be unlawful to keep open for business or to admit the publication remain within, or to permit the consumption of alcoholic liquor in or upon any premises in which alcoholic liquor is sold at retail during the hours within which the sale of such liquor is prohibited; provided, that in the case of clubs, restaurants, motels and hotels, such establishments may be kept open for business during such hours, but no alcoholic liquor may be sold to, or consumed by the public during such hours.
