(A) In case any existing culvert under any private drive or roadway fails to comply with the provisions of this subchapter, or impedes the free flow of water in the ditch in which it is installed, the owner or occupant of the property into which such drive or roadway leads, upon notice from the city, shall install a proper culvert in accordance with the provisions of this subchapter at the sole expense of the owner or occupant.
(B) Any existing culvert which subsequently shall be ordered removed by the city, shall be removed and replaced at the sole expense of the owner or occupant.
