§ 95.99 PENALTY.
   (A)   Any person, firm or corporation who violates any provision of this chapter for which another penalty is not specifically provided shall, upon conviction, be subject to a fine not less than $25, nor exceeding $500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.

   (B)   (1)   A person who smokes in an area where smoking is prohibited by §§ 95.30 through 95.39 of this chapter shall be guilty of an infraction, punishable by a fine not more than $100.
      (2)   A person who owns, manages, operates or otherwise controls a public place who fails to comply with the provisions of §§ 95.30 through 95.39 of this chapter shall be guilty of an infraction, punishable by a fine up to $100.
      (3)   Each day on which a violation of §§ 95.30 through 95.39 of this chapter occurs shall be considered a separate and distinct violation.
