§ 51.042 APPLYING FOR WATER SERVICE.
   (A)   At the time of making an application for water service, any person, firm, corporation or entity for a residential property shall pay a service fee to the city of $250. The meter and outside meter reader shall remain the property of the city.
   (B)   At the time of making an application for water service, any person, firm, corporation or entity for commercial property shall pay a meter service fee equal to the current price quoted by the manufacturer for a water meter based on the size of the meter and the amounts of water usage. The meter, outside remote and transceiver unit shall remain the property of the city. If a meter is removed for any reason, the owner will be charged $150 to replace the meter. If the outside transceiver unit is removed for any reason, the owner will be charged $150 to replace the meter and $75 to replace the bottom plate.

   (C)   (1)   All billing for the water service shall remain in the name of the owner of said premises; unless such other person as might claim an interest in the property in question shall make an application with:
         (a)   A copy of the deed which shows they have interest in the property;
         (b)   A copy of a death certificate of the current owner and a Will which shows that the current owner devised the property to them; or
         (c)   A copy of a trust agreement that shows that they have power of direction in the trust agreement and they pay the appropriate service fee and comply with such other rules and regulations of the Water Department.
      (2)   Tenants cannot apply for water service for residential property without the authorization of the owner. The owner must complete and sign the application on the tenant’s behalf understanding they will be solely responsible if the tenant(s) vacate(s) the property leaving any outstanding balances on the water account. Owner also must provide a copy of the tenant’s signed lease. Any commercial tenant that applies for water service must provide a copy of their signed lease with the owner.
   (D)   Upon termination of residential or commercial service at a particular premise, the city will refund the service fee paid, less the outstanding water charges, and, if applicable, cost for repairs and/or replacement for any damage to the meter, meter parts or remote meter reading equipment.
   (E)   It shall be the duty of all owners or managers of the property located within the city limits and receiving water service from the city, to notify the Water Department when there is a change of occupancy of the premises in question. Said notice shall be in writing to the Water Department, and provide among other things, the street address of the property, the tax permanent index number of said property, the name of the person surrendering occupancy of the premises their forwarding address and the name of the persons to commence occupancy of the premises or a statement under oath stating the premises will remain unoccupied and that the person so reporting will inform the city when a new occupant occupies the premises.
   (F)   All businesses must apply for service before the issuance of a city business license.
