§ 51.019 BOND REQUIRED FOR INSTALLATION OR EXTENSION OF WATER MAINS.
   (A)   Any person making an installation or extension of water mains within the city shall, before commencing work, furnish the city with the following: a surety bond or performance bond in an amount to be determined by the Mayor and City Council.
      (1)   The surety or performance bond shall be made payable to the city for an injury to any person or property, or death to any person or persons from any accident that is directly or indirectly resultant from such installation and shall further, by the bond, save, protect and render the city harmless from all damage, cost or expenses, suits or cause of action that may arise as a consequence of such installation, or the use of defective materials or workmanship.
      (2)   The bond shall further stipulate that any change, deviation or violation in plans as submitted to the Mayor and City Council for approval shall be construed as creating an immediate liability of surety and the principal under the bond.
      (3)   An opportunity shall be given the person to rectify the change, deviation or violation within a reasonable time set by the Mayor and Council.
   (B)   The Mayor and Council may waive these requirements in their sole discretion.
