§ 39.21 PERFORMANCE BOND.
   When the Mayor determines that the provisions of a performance bond which would otherwise be required by any law, rule or regulation of the city or by any state law, rules or regulation which does not preempt the power of municipal units of local government is not needed to protect the city, and when an alternative means of protecting the city in the performance of work is available, a requirement of a performance bond shall not be included as part of the bid specifications. It is the policy of the city that this procedure should be utilized when it is determined that the requirement of a performance bond would tend to discourage minority business enterprises form doing business with the city.
