Whenever any owner, firm, manager or operator of motel or hotel accommodations within the city shall fail to pay any tax due under this subchapter the City Attorney shall, at the request of the Mayor or City Treasurer, institute an action to enforce and collect payment for the tax due in any court of competent jurisdiction within the state.
