The city has adopted the “rolling 12-month period” method of calculating available FMLA leave. In order to determine the amount of available FMLA leave, the calculation is made each time an employee commences any FMLA leave from that date, the preceding 12-month period is examined. Any FMLA leave used during that preceding 12-month period is examined. Any FMLA leave used during that preceding 12 months is deducted from the 12 weeks annual leave granted by the FMLA. The employee is entitled to take no more than the remaining balance of the FMLA leave.
