All excavation and construction within public rights-of-way within the Marion city limits shall require a permit issued by the city upon application of the property owner, licensed contractor, or utility performing the work. Excavation and construction includes, but is not limited to, the installation, repair, and replacement of driveways, sidewalks, all public and other utilities, and other projects involving construction activities over, upon, or beneath the public rights-of-way. Excavations and construction extending for a linear distance of one-half mile or greater shall require the approval of the city council, except in the case of franchise utilities exempted by franchise agreements.
