§ 136.01 LOITERING OF MINORS; CURFEW.
   (A)   (1) It shall be unlawful for any minor under the age of 18 years to loiter, idle, or remain in or upon the public streets, highways, roads, alleys, parks, playgrounds, public places and public buildings, places of amusement and entertainment, vacant lots, or other unsupervised places between the hours of 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday, and Thursday evenings and 5:00 a.m. of the following days and between the hours of 12:00 midnight on Friday and Saturday and 5:00 a.m. of the following days, official city time.
      (2)   Provided, however, that on Halloween Night of each and every year, it shall be unlawful for any minor under the age of 18 years to loiter, idle, or remain in or upon the public streets, highways, roads, alleys, parks, playgrounds, public places and public buildings, places of amusement and entertainment, vacant lots, or other unsupervised places between the hours of 6:00 p.m. and 5:00 a.m. of the following days, official city time.
   (B)   This section does not apply to a minor who is:
      (1)   Accompanied by his parent, guardian, or custodian;
      (2)   Accompanied by an adult specified by his parent, guardian; or
      (3)   Participating in or returning from lawful employment or a lawful athletic, educational, entertainment, religious or social event.
   (C)   Responsibility of parent. It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of 18 years to allow or permit such minor to violate division (A) above.
   (D)   Procedure by arresting officer upon a violation. All minors under the age of 18 years arrested under the provisions of this section shall be taken to his home and the arresting officer shall ascertain whether the minor is within the control of his parents, guardian, or other adult person. If the parents, guardian, or other adult person shall state that the minor cannot be controlled by them, or if the parents, guardian, or other adult person having the care and custody cannot be located, then the minor shall be detained in the juvenile facilities provided by the county, and shall be subject to the proper order of the district court. Any parent, guardian, or other adult person having the care and custody of the minor violating the provisions of this section shall be fined not less than $10 nor more than $100 or confined in jail not more than 30 days or punished by both said fine and imprisonment for each separate offense.
