§ 98.20 PURPOSE AND INTENT.
   It is declared that the purpose of this subchapter is to provide for the removal of vehicles along city streets to allow for the sweeping of streets by making it unlawful for a person to park any vehicle on a public street within the city for such times, such days and under such circumstances as described in this subchapter from April 1 to October 1 of each year as posted.

§ 98.21 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AUTHORIZED EMPLOYEE. Any individual of the Code Enforcement or Marion Police Department having enforcement powers so designated to enforce this chapter.
   HANDICAP PARKING. A permanent handicap parking space so posted with a handicap parking sign.
   STREETS. The real estate within the city which is controlled or occupied by the city or state for the use of parking or travel.
   VEHICLE. Any machine designed to travel along the ground by use of wheels, treads, runners or similar devices used to transport person, property or pull machinery, including but not limited to the following: automobiles, motorcycles, trucks, trailers, tractors or boats.

§ 98.22 PROHIBITED ACTIVITIES.
   It shall be unlawful for the owner of any vehicle to park on a city street in violation of the posted street sweeping signage, except for handicap licensed vehicles parked in a designated handicapped parking spot.

§ 98.23 VIOLATION.
   (A)   Any officer who finds a vehicle to be illegally parked in accordance with the posted signage shall attach a parking ticket in a prominent place. The vehicle is then considered illegally parked and the owner shall be held responsible for all costs incurred by the processing. The owner shall be responsible to pay the fine against the vehicle and if these costs are not paid within 30 days, the owner shall be taken to city court and incur all costs associated with the collection of said findings as determined by the court.
   (B)   A violation of the provisions of this subchapter shall be punishable by a fine as determined by § 10.99. If the fine is paid within 30 days there will be no additional cost. Fines not paid in the 30 day period will then be processed through the courts and additional court costs may be assessed. During the first two months of the implementation of this subchapter, the owner of an illegally parked vehicle shall be given a written warning of the violation. After the two months, all illegally parked vehicles shall be ticketed.

§ 98.24 COLLECTION OF MONEY.
   All monies collected under this subchapter shall be returned to the General Fund Account of the City of Marion.

STREET USE REGULATIONS
§ 98.35 GAMES AND SPORTS.
   No person shall play or engage in any game or sport upon any city street. Any person who violates this subchapter shall be deemed to have committed an ordinance violation and, upon conviction, shall be fined as determined in § 10.99 for each offense.
