§ 95.71 DEFINITIONS.
   For the purpose of this subchapter, the following terms shall have the following meanings. The word “shall” is mandatory and not merely directory.
   AUTHORIZED EMPLOYEE. An individual designated to make the necessary inspections and enforce this subchapter for the city. This individual shall be an employee of the Marion Police Department or the Marion Code Enforcement Department, or any other individual designated by the Mayor of the City of Marion to enforce this subchapter.
   CITY. City of Marion.
   DONATION DROP BOX. A donation drop box is any receptacle used for collection of clothing, shoes, household goods and other items of personal property donated by the public for redistribution.
   PUBLIC NUISANCE. For the purposes of this subchapter, the word NUISANCE shall be defined as set forth in I.C. 32-30-6-6. The following is a list of public nuisances, but does not limit, the condition constituting a nuisance under this subchapter section:
      (1)   Accumulations of rubbish, trash, refuse, junk and other abandoned materials; and
      (2)   Any condition which provides harborage of rats, mice, snakes, insects and other vermin.
   OFFICER. An officer of the Marion Code Enforcement Department or Marion Police Department or any other governmental department of the city, or an employee so designated by the Mayor of the city having enforcement powers to issue city ordinance violation citations in order to enforce the provisions of this subchapter.
   OWNER. Any one or more of the following:
      (1)   The owner or owners in fee simple of a parcel of real estate including a life of the tenant if any; or
      (2)   The record owner or owners as reflected by the most current records in the Grant County Assessor's office; or
      (3)   The purchaser or purchasers of such real estate under any contract of the conditional sale thereof.
   PRIVATE PROPERTY. All real estate within the city except governmental property.
   OPERATOR. A person who manages the organization for which the donations are solicited.
