§ 158.012 PUBLIC HEARINGS.
   When an appeal of an action or decision by the enforcing agency or a request for a variance to a specific requirement of the single state construction code has been filed with the Construction Board of Appeals in the proper manner on the required form as prescribed by the Construction Board of Appeals, such matter shall then be scheduled for a public hearing thereon by the Board within a reasonable period of time. Notices of such public hearing indicating the time, place and subject matter of the public hearing shall be served personally or by mail at least seven days prior to the date of such public hearing upon the applicant or appellant, upon the enforcing agency of the city, and upon the owners of property within 300 feet of the subject property, as disclosed by the most recent tax assessment rolls. Any interested party may appear at such public hearing in person or by a duly authorized agent or by attorney.
