§ 158.008 OFFICERS; MEETINGS; RULES OF PROCEDURE; QUORUM AND VOTING; RECORDS; WITNESSES.
   (A)   Election of Chairperson and Vice-Chairperson. The Construction Board of Appeals shall elect from its membership a Chairperson and a Vice-Chairperson who shall serve in such capacities for the term as fixed and established by the Board. The Chairperson shall preside over the Board and shall chair the meetings of the Board. The Chairperson shall have the right to vote on all matters coming before the Board unless precluded by law. The Vice-Chairperson shall, in the absence of or disability of the Chairperson, perform the duties and functions of the Chairperson.
   (B)   Public meetings. The business which the Construction Board of Appeals may perform shall be conducted at a public meeting of the Board and shall be held in compliance with the open meetings act, Public Act No. 267 of 1976. Public notice of the time, date and place of all meetings of the Board shall be given in the manner required by such act.
   (C)   Rules of procedure. The Construction Board of Appeals shall adopt and promulgate rules of procedure to govern and control its business and affairs and all matters coming before it. The Board shall also create and approve all necessary forms to be used by persons desiring to formally bring matters before the Board.
   (D)   Scheduling and holding of meetings. Meetings of the Construction Board of Appeals shall be held at the call of the Chairperson and at such other times as the Board shall determine to be necessary and proper to carry out the functions and duties of the Board.
   (E)   Quorum and voting requirements. Three members of the Construction Board of Appeals shall constitute a quorum for the transaction of business at a meeting of the Board. No motion, resolution or other formal decision shall be adopted, passed or taken except by the affirmative vote of at least three members of the Board.
   (F)   Records. The Construction Board of Appeals shall keep and maintain minutes of its meetings and proceedings, which such minutes shall indicate and describe the nature of all matters coming before and/or decided by the Board and the votes and/or actions of all members of the Board. Such minutes of the meetings and proceedings of the Board shall be filed with the City Clerk. All records of decisions made by the Board, properly indexed, and any other writings prepared, owned, used, in the possession of, or retained by the Board in the performance of an official function shall be considered to be public records and shall be made available to the public in compliance with the Freedom of Information Act, Public Act No. 442 of 1976.
   (G)   Witnesses. The Chairperson of the Construction Board of Appeals or, in his or her absence, the Vice-Chairperson may compel the attendance of witnesses at the meetings and proceedings of the Board and may administer oaths to any such witnesses.
