For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DRIVER'S LICENSE. A license, permit, or temporary license issued under the laws of the State of Michigan pertaining to the licensing of persons to operate motor vehicles.
GOLF CART. A vehicle designed for transportation while playing the game of golf. For the purposes of this subchapter, off-road vehicles, as defined herein, are not considered golf carts.
OFF-ROAD VEHICLE ("ORV"). A motor-driven, off-road recreational vehicle capable of cross-country travel without the benefit of a road or trail, on or immediately over land, snow, ice, marsh, swampland, or other natural terrain. ORV includes, but is not limited to, a multi-track or multi-wheel drive vehicle; an all-terrain vehicle ("ATV"); an amphibious machine; a ground-effect air cushion vehicle; or other means of transportation deriving power from a source other than muscle or wind. For the purposes of this subchapter, this definition shall not include a minibike or minicycle as defined and regulated in §§ 70.015 et seq. of this code.
OPERATE. To ride in or on, or be in actual physical control of a golf cart or an off-road vehicle.
OPERATOR. A person who operates and/or is in actual physical control of a golf cart or an off-road vehicle.
STREET. A road, roadway, street or right-of-way within the city street system, but does not include a private road. The terms road, roadway, street and right-of-way are interchangeable.
SUNSET AND SUNRISE. Sunset and sunrise as determined by the National Weather Service on any given day.
