Shall any person whose property is benefitted by any excavation or opening in or under any street, alley or public place, fail to restore the street, alley or public place to its original condition requiring the city to incur expense for restoration of same, the city Commission shall by resolution levy the expense so incurred as a special assessment under § 154.003 of this code of ordinances against the property so benefitted.
