§ 52.35 PURPOSE AND POLICY.
   (A)   A subchapter regulating private and public sewers, sewer connections, industrial waste pretreatment facilities and discharge of industrial waste into the publicly operated treatment works and providing for pollutant limitations, data collection, monitoring and sampling, and providing for penalties for the violation thereof, in the City of Marine City, County of St. Clair, State of Michigan.
   (B)   The objectives of this subchapter are:
      (1)   To prevent the introduction of pollutants into the wastewater system which will interfere with the normal operation of the system or contaminate the resulting municipal sludge;
      (2)   To prevent the introduction of pollutants into the wastewater system which do not receive adequate treatment in the POTW, and which will pass through the system into receiving waters or the atmosphere or otherwise be incompatible with the system;
      (3)   To improve the opportunity to recycle and reclaim wastewater and sludge from the system; and
      (4)   To provide for equitable distribution of the cost of municipal wastewater system.
   (C)   This subchapter provides for the regulation of direct and indirect contributors to the municipal wastewater system through the issuance of permits to certain non-domestic users and through enforcement of general requirements for the other users, authorizes monitoring and enforcement activities, requires user reporting, assumes that existing customer’s capacity will not be preempted, and provides for the setting of fees for the equitable distribution of costs resulting from the program established herein.
   (D)   (1)   This subchapter shall apply to the city and to persons outside the city who are, by contract or agreement with the city, users of the city POTW.
      (2)   Except as otherwise provided herein, the superintendent of the city POTW shall administer, implement and enforce the provisions of this subchapter.
