(a) No person shall allow for the interment of human remains within the corporate limits of the City of Marietta, Ohio, other than in existing cemeteries. As to be used for this section, human remains are defined as the following: a deceased human body.
(b) Any person who violates this provision shall be subject to a fine not to exceed one thousand dollars ($1,000) and imprisonment not to exceed six (6) months. Additionally, any person convicted of a violation of this section, shall have accessed as part of the court costs of the action, the costs of having the interred body removed and reinterred in an existing cemetery.
