(a) No brick street or brick alley shall be repaved with any material other than brick;
(b) No brick street or brick alley shall be repaired with any material other than brick; except in the event of an emergency opening of the pavement (other than for surface pavement maintenance); provided however, that in the event of such an emergency opening of the pavement (other than for surface pavement maintenance), the brick street or brick alley so repaired shall be restored to its original brick status within one hundred twenty (120) days of the emergency repair;
(c) Any repair with material other than brick, for surface pavement maintenance by the City Street Department or its agents, shall be restored to its original brick status within
one (1) year;
(d) Any individual, utility company, contractor or other organized paving company that opens a brick street or brick alley shall do so only in accordance with the terms and conditions of the standard specifications of the City Engineer for the repair of brick streets and brick alleys; and
(e) Whoever violates subsections (a), (b), (c) or (d) above, shall be guilty of a minor misdemeanor, punishable in accordance with the terms of Section 501.99 of the Codified Ordinances of the City of Marietta. Ohio.
