(b) Any person who negligently violates or continues to violate any provision of this chapter, other than Section 928.18, beyond the time limit for compliance set forth by the Water Superintendent, notice of violation by the Water Superintendent, or a compliance schedule established by the Water Superintendent, shall be subject the following:
(1) The first violation shall be punishable by a fine in an amount not to exceed five hundred dollars ($500.00).
(2) A subsequent violation of the same provision shall constitute a misdemeanor of the first degree, punishable pursuant to the City of Marietta Codified Ordinance Chapter 501.
(3) A continuing violation of any provision of this chapter shall be punishable by an additional fine of five hundred dollars ($500.00) per day.
(c) Notwithstanding the fine and imprisonment provisions of this chapter, the violator is responsible for costs of cleanup and remedial expenditures required to restore the site to its condition as it existed before the violation. The violator may be held responsible only for that contamination which the violator caused. The Water Superintendent is authorized to recover only those costs reasonably related to the violation.
