Subject to applicable provisions of law, the Water Superintendent or his/her authorized designees bearing proper identification shall be permitted to enter private property at any reasonable time for such purpose as, but not limited to, inspection, observation, measurement, sampling and records examination pertaining to the requirements of these regulations to insure that the activities are in accordance with the provisions of this chapter. If the owner or tenant does not consent to the entry of the Water Superintendent or his/her designated for the above stated purposes, the Water Superintendent may apply to a court of competent jurisdiction for an appropriate warrant or other authority to enter the property, and the owner or tenant shall bear the cost of such court action. All users of regulated substances within the wellfield protection area shall be inspected at a minimum on a semiannual basis, and all mining operation permitted under Section 928.10 shall be inspected at minimum on a monthly basis.
