Where it appears that the implementation of the provisions of this chapter create a hardship upon any affected party, the Water Superintendent may waive the application of the chapter upon such terms and conditions as the Water Superintendent deems necessary and appropriate to implement the purpose of this chapter, as long as such waiver does not substantially increase any risk to the public health, water supply, wells or wellfields.
