No person shall, on any public street, alley, drive, lane, thoroughfare, right-of-way, court, highway, boulevard, or on the sidewalks thereof, or in any public park, playground, or other publically owned property, solicit the sale of any merchandise, wares, goods, periodicals, or other articles of value for present or future delivery, subject to the following exceptions:
(a) Merchants shall be permitted to sell merchandise, wares, goods, periodicals or other articles, and sell and/or serve foods on the sidewalk located immediately adjacent to the front of their business, so long as a minimum clear passage width of at least forty-eight inches (48") is maintained at all points on the sidewalk in front of the business.
(b) Merchants selling and/or serving foods on the sidewalk who possess a liquor permit issued by the Department of Commerce, Division of Liquor Control, must apply for a license from the Director of Public Safety and Service, accompanied by a detailed sketch of the sidewalk located immediately adjacent to the front of their business, illustrating the number of tables and chairs with measurements. The positioning of said tables and chairs as detailed in the sketch shall maintain at all points on the sidewalk in front of the business, a minimum clear passage width of at least forty-eight inches (48").
