(a) "Overtime work" shall be defined as time worked in excess of the standard forty-hour work week for City employees compensated on an hourly basis.
(b) (1) The following positions shall be salaried and the incumbents thereof shall be exempt from receiving overtime pay: all elected officials of the City, the Director of Public Safety and Service, the Budget/Procurement Director, the Human Resources Director, the Development Administrator, the City Engineer, the Assistant City Engineer, the Clerk of the Municipal Court, the Assistants to the Law Director, the Police Chief, the Police Captains, the Fire Chief, the Assistant Fire Chief, the Mayor's Administrative Assistant, the Chief Deputy Auditor, the Deputy Tax Administrator, the IT Managers, the IT Administrator, the Utilities Administrator, the Public Works Director, the Public Works Superintendent, the Water Superintendent, the Wastewater Superintendent, the Wastewater Operations Manager and any other position with the City where the incumbent thereof is compensated on a salaried rather than hourly basis, and primarily performs exempt job duties.
(2) Provided, however, that the incumbents of the positions set forth above, except for elected officials, shall be entitled to receive paid time off (PTO) at the rate of one hour for each hour worked in excess of forty hours per week. Requests to use PTO shall be made not less than forty-eight hours in advance of the time intended for its use. PTO, may accumulate up to a maximum of 240, but shall be taken within 180 days of the date upon which it was earned or it shall be lost.
(c) Hourly employees shall be compensated for time worked in excess of their standard forty hour work week by payment of compensation at a rate of one and one half times the employee's applicable regular rate of pay for time worked in excess of forty hours in a work week.
(1) In lieu of pay for overtime the employee may request compensatory time off at the rate of one and one-half hours off for each hour of overtime worked. Such request shall be made not less than forty-eight hours in advance of the time when the employee has requested the compensatory time off.
(2) Overtime hours worked for which neither payment has been made, nor for which compensatory time off has been taken, may accumulate up to a maximum of 240 hours, any hours in excess thereof shall be paid. Compensatory time off must be taken within 180 days of the date upon which it was earned or it shall be lost.
(d) Overtime work shall be approved in advance, when practicable, by the Director of Public Safety and Service or the employee's applicable appointing authority. An employee shall be entitled to receive a minimum of two hours' overtime compensation as set forth above when required to return to work as the result of a call-out by the Director of Public Safety and Service or the employee's applicable appointing authority, provided that all other requirements for overtime compensation as set forth herein are met.
(e) All seasonal amusement and recreational employees of the City shall be exempt from receiving overtime pay hereunder.
(f) The provisions of this Ordinance may be modified through collective bargaining, subject to state and federal wage and hour laws.
