311.02 PARADES AND ASSEMBLAGES.
   (a)   All streets and parades, processions and street assemblages occupying, assembling or marching upon any street or public place, except the National Guard and funeral processions, are prohibited unless a permit therefor in writing shall first have been obtained from the Mayor or the Director of Public Safety and Service. Such permit shall designate what streets or other public places such parade or assemblage shall occupy. All parade vehicles shall be kept at least twenty feet apart.
   (b)   The Director of Public Safety and Service is hereby authorized and directed to prohibit vehicular parking on that portion of any street designated as a part of the parade route for the duration of any parade authorized under subsection (a) hereof. No person shall park any vehicle in violation of a parking prohibition enacted by the Director of Public Safety and Service pursuant to this subsection. Any vehicle parked in violation of a parking prohibition authorized by this subsection may be removed by order of the Director of Public Safety and Service or by the Chief of Police pursuant to Section 353.11 of this Traffic Code.
   (c)   A violation of subsection (b) of this section shall not be considered a criminal offense for any purpose. A person who commits the violation shall not be arrested as a result of the commission of the offense. Any violation of subsection (b) of this section shall be handled pursuant to Chapter 353. of the Marietta Codified Ordinances. The fines and penalties for violation of this section shall be as set forth in the fee schedule in Section 353.12. In addition, where a vehicle is towed as a result of a violation of subsection (b) of this section, the vehicle can be recovered only upon payment of the towing charges imposed.
