Section 103.5 FEES.
Schedule of Fees:
(a) Fines.
(1) First Offense - $50.00
(2) Second Offense - $100.00 (if committed within 24 months of the first offense)
(3) Third or Subsequent Offense - $200.00 (if committed within 24 months of the second or subsequent offense)
(4) If the fine is not paid within ten (10) business days from the date levied, the Director of Public Safety and Service shall cause a written account of the fines owned and proper description of the property to be made to the County Auditor and entered upon the tax duplicate and be a lien upon the real estate where the offense occurred and be collected as other taxes and returned to the General Fund of the City of Marietta, Ohio.
(b) Costs to City to Abate Nuisance.
(1) When the Director of Public Safety and Service shall authorize the use of City labor, materials or equipment to abate a nuisance, he shall calculate and charge, as per Chapter 951 of the Codified Ordinances, all costs associated with such abatement; or shall charge the actual costs plus Administrative Fee for contract services to abate such nuisance.
(2) All costs calculated to abate the nuisance shall be billed and mailed by certified mail, return receipt requested, to the owner of the property where such nuisance exists.
(3) If the owner fails to pay the City for such costs billed, the Director of Public Safety and Service shall cause a written account of all costs incurred, a description of the work performed and a proper description of the property involved to be made to the County Auditor for the amount due and entered upon the tax duplicate and be a lien upon the real estate and be collected as other taxes and returned to the General Fund of the City of Marietta, Ohio.
