The Director of Public Safety and Service, upon the written application of the owner of any premises in the City, or his duly authorized agent, wishing to construct or repair a building or other structure thereon, may grant a permit to such owner to occupy, for the purpose of placing building material thereon, not to exceed one-half the width of the sidewalks and one-third the width of the street adjacent to such premises. However, the owner and the person or contractor who shall be engaged in the construction or repair of such building or structure shall keep the gutter, one-half the width of the sidewalk and two-thirds the width of the street free and clear of all building materials, shall remove the remains of each kind of material as soon as it is no longer needed in such construction or repair and, upon the completion of the same shall remove all material placed in the street or sidewalk, and shall comply with all the ordinances of the City relative to the placing of such material in the line of the streets.
All building material deposited within the line of the street shall have red lights placed upon or about it from dusk until dawn so as to give sufficient warning to all persons passing along such street. It shall be the duty of the person for whom any building is being erected, and of the contractor in charge of the work of erecting the same, to see that building material is deposited and that lights are placed as required by this section.
