139.06 HOURS OF WORK AND OVERTIME.
   (a)   The regular work week shall consist of forty hours, five days of eight hours each, unless an officer is scheduled on a multiple-week cycle, in which event, such employee shall average forty hours per week during the cycle, a week being seven consecutive days.
   (b)    A day shall be defined as a full twenty-four hour period. A day shall begin with the officer's starting time.
   (c)    Any officer working in excess of eight hours on his assigned shift shall be compensated at the rate of one and one-half of his base rate for all such excess time. Any officer who works on his normal scheduled day off shall be compensated at the rate of one and one-half of his straight time rate for all such time worked except where the parties agree that the officer shall work such day in exchange for another day off.
   Officers who are on a straight forty hour per week schedule shall receive time and one-half for all hours worked in excess of forty straight time hours. Officers on multiple week cycles shall receive time and one-half for all hours in excess of the average forty hours per week during the cycle.
   (d)    There shall be no pyramiding of premium pay for the same hours worked.
   (e)    Overtime shall be voluntary and not required except in situations which are deemed necessary by the Police Chief. Once an overtime assignment is accepted it shall be considered part of an officer's normal and regular work assignment, except that inability to work based on illness shall not require the officer to use sick leave.
   (f)    There shall be no overtime paid to officers who work more than eight hours in a twenty-four hour period while changing from one shift to another.
   (g)    Call-in pay is defined as payment for work assigned by the Chief or his designee, or for court time as defined in subsection (h) hereof and performed by an officer more than one-half hour prior to the start of the normal shift and at a time disconnected from his normal and prescheduled hours of work.
   Work done in this manner shall be compensated at the rate of one and one-half times the normal rate of pay with a minimum of three hours pay (two hours at a pay rate of time and one-half) and shall be paid only during the time the officer is physically performing his assignment.
   (h)    Whenever it is necessary for an off-duty officer to appear in court or for pre-trial conferences for the prosecution of a criminal case, such officer shall be compensated in accordance with the provisions of subsection (g) hereof. Any witness fees received as a result of court appearances in connection with City employment shall be turned over to the City Auditor within three days of receipt of such fees. After the completion of any such appearance, the officer shall not be required to take a duty assignment, except as may be provided in subsection (g) hereof, until his normally assigned hours. Officers shall give the Chief or his designee advance notice of any such appearances.
