EDITOR'S NOTE: By deed dated December 11, 1933, and recorded at Volume 205 Page 617 of the Deed Records of Washington County, Ohio, Marietta College conveyed certain real property in Square 65 of the City of Marietta, Ohio, to the City of Marietta, Ohio, on the condition that a Municipal Stadium be erected thereon. Marietta College reserved in that deed the first preference for the use of the Municipal Stadium. Pursuant to the terms of Ordinance No. 218 (80-81), passed August 6, 1981, and by deed dated September 8, 1981, and recorded at Volume 537 Page 16 of the Deed Records of Washington County, Ohio, the City of Marietta, Ohio, conveyed the real property on which the Municipal Stadium is located to the Board of Education of the City of Marietta, Ohio, subject to the restrictions set forth in its deed from Marietta College and further subject to restrictions as to its use as set forth in Ohio Revised Code Section 721.02. Pursuant to the terms of a resolution adopted by the Board of Education of the City of Marietta, Ohio, and by deed dated December 23, 2003, and recorded at Volume 384 Page 1133 of the Official Records of Washington County, Ohio, the Board of Education of the City of Marietta, Ohio, conveyed the real property on which the Municipal Stadium is located to the Board of Trustees of Marietta College subject to the restrictions more fully described above and further subject to the terms and conditions of a Master Agreement for the use of the Municipal Stadium recorded in the Official Records of Washington County, Ohio contemporaneous therewith.
