923.02 SCHEDULE OF RATES.
   For the purposes provided in Section 923.01, there is hereby levied and charged upon each lot, parcel of land or premises having a connection with the system or otherwise discharging sewage, industrial wastes, water or other liquids, either directly or indirectly into the system, or capable of being served by the system, sewer charges payable as hereinafter provided and in amounts to be determined as follows:
(a)    Water Consumption Charge. Except as hereinafter otherwise provided, sewer charges at the rates provided in this section, with respect to any premises, shall be based upon the water consumption charge for the premises for the billing period applicable to the premises. "Water consumption charge" means the amount payable or which would be payable for the water consumed upon the premises and discharged into the system, measured as provided in Section 923.04, during the applicable sewer charge billing period and charged for at the City water rate applicable to the premises for water service in the City.

(b)    Domestic Sewer Rate. Applicable to all active connections with the system not falling within the classifications described hereinafter in this section there shall be a sewer charge based upon water consumption or metered sewage in 100 cubic foot increments according to the following schedule:

(c)    Commercial, Industrial and Business Sewer Rate. Applicable to all commercial, industrial or business establishments regularly employing more than four persons during the billing period for which the charge is being made; there shall be a sewer charge based upon water consumption or metered sewage in 100 cubic foot increments according to the schedule provided in subsection (b) hereof.

(d)    Minimum Rate Apportioned. The minimum rate provided for in subsection (c) hereof shall be apportioned in the case of any establishment not receiving sewer service for the entire quarter annual period for which the charge is being made.
(e)    Surcharge for Acceptable Industrial Waste. In addition to the commercial, industrial and business rate provided in subsection (c) hereof, those establishments subject to such classification which are producing acceptable industrial wastes shall pay a surcharge, based upon the added weight of suspended solids (SW) and a five-day biochemical oxygen demand (BOD) found in the sewage from the establishment, which is in excess of normal sewage (NS), in order to compensate the City for additional capital expenditure and operating costs imposed by the load received from such establishment. For the purposes of determining the surcharge provided for by this section, normal sewage (NS) shall be considered to contain 2,500 pounds per million gallons of flow or 300 parts per million (ppm) of suspended solids (SW) and 2,000 pounds per million gallons of flow or 240 parts per million (ppm) of five-day biochemical oxygen demand (BOD). As specified by the Ohio Department of Health, the percent of treatment to be accomplished by the City's disposal system is forty-five percent being the removal factor (RF); the amount of flow (F) at the customer's plant will be measured by the City over twenty-four hour periods, as cubic feet (CF) or million gallons (MG), with a conversion factor of 133,690 to translate million gallons to cubic feet. (One part per million gallons is understood to weigh eight and three hundred forty-five hundredths pounds.)
   The surcharge volume (SV) upon which the surcharge herein provided shall be based shall be determined by the following formula:

The amount of such surcharge shall be five cents (5¢) per SV/100 measured in cubic feet (CF) as determined for each quarter.
   For the purposes of determining such surcharge the City will make one SW and BOD analysis and flow determination per calendar year with reference to each establishment subject hereto. Samples will be composited over twenty-four hours during a regular operating day, unless the intermittent character of the plant's output requires longer test periods, as in the case of abattoirs. If the proprietor of any such establishment so requests, additional flow measurements and analysis will be made by the City at the proprietor's expense to be charged for as follows: Fifty dollars ($50.00) per twenty-four hour flow test. Twenty-five dollars ($25.00) per composite sample analysis. The proprietor of any establishment producing industrial waste shall install at his own cost, a suitable manhole in the sewer for the use of the City, and will provide all common labor necessary to install and operate the sampling equipment, under the supervision and to the satisfaction of the City, and an analysis will be made by the City.
(f)    Air Conditioning Rate. On all premises utilizing water produced otherwise than from the City waterworks system for air conditioning or cooling purposes, the waste from which process is discharged into the system, an additional sewer charge shall be made in the amount of fifty dollars ($50.00) per quarter, provided that if the Director of Public Safety and Service shall determine that the amount of water so discharged is excessive and unduly burdensome to the system, an increased rate may be established in the manner provided in Section 923.03. All owners or users of premises employing water produced otherwise than from the City waterworks system for air conditioning or cooling purposes are hereby required forthwith to report the same to the Director whenever such system is in operation or is placed in operation.
   If, in the judgment of the Director of Public Safety and Service, the discharge from a cooling system is overloading the sewer or plant and the water is not contaminated by objectionable materials, the Director may require the owner to dispose of the water in such other way as may be best in the judgement of the Director.
(g)    Readiness to Serve Charge. Applicable to all premises having an inactive connection with the system, being premises for which, during a billing period, no water consumption charge shall accrue; and also to all premises having no connection with the system but for which a sewer curb connection to the system has been provided; the fee shall be one dollar ($1.00) per quarter.

(h)    Flat Rate for Users Not Connected to City Water Lines. 
(1)    There is hereby established a flat rate of fifteen dollars ($15.00) payable bimonthly for utilization of the City sewer lines and treatment facilities for the disposal of sewage from each user located within the corporate limits of the City and not connected to City water lines.
(2)    There is hereby established a flat rate of twenty-two dollars and fifty-five cents ($22.55) payable bimonthly for utilization of the City sewer lines and treatment facilities for the disposal of sewage from each user located outside the corporate limits of the City and not connected to City water lines.
