729.09 VIOLATION.
   Whenever the City Solicitor, based upon the inspections made by the Chief of Police, is of the opinion that a junk yard within the City is being operated or maintained in violation of this chapter or Ohio R.C. Chapter 4737, he may apply, in the name of the State, to a court of competent jurisdiction alleging the violation complained of and praying for an injunction or other proper relief. An action brought under this section for an injunction or an abatement of the junk yard as a nuisance shall not be deemed to be a bar to a prosecution for payment of fine under Section 729.99.
