§ 95.10 HUNTING, CUTTING TIMBER, AND FIREARMS IN DOGWOOD PARK.
   (A)   Dogwood Park, which for purposes of this section, as well as any other reference in the Mariemont Code of Ordinances to Dogwood Park, shall be described as follows:
      (1)   Dogwood Park is Mariemont's largest green space, which includes the Dogwood Park Nature Trail, a hiking trail through old growth parkland along Whiskey Run Creek, the historic Boathouse, Bell Tower, and Carillon, the Tot Lot (a modern children's playground), ball fields, swimming pool, the Madisonville, Joseph Ferris Mill, and Joseph Ferris Distillery archaeological sites.
      (2)   Dogwood Park encompasses all of the land located from the intersection of US 50 (Wooster Pike) and Pleasant Street and extends west to intersection of US 50 and Park Lane. Its boundary continues south of the intersection US 50 and Park Lane for 269.4 feet around a private parcel (southeast 81.9 feet, southwesterly for 147.55 feet, and northwest 90.23 feet to Park Lane). It then continues southwest 344.69 feet, then southeast 105.44 feet, southwest 473.57 feet, north 74.28 feet, and west 533.89 feet to the corporation line. Following the corporation line, the park boundary continues south 372.55 feet, then southwest 452.01 feet, south 141.66 feet, east 105.89 feet, south 210.05 feet, east 193.39 feet, and south 336.78 feet to the Norfolk Southern (NS) Railway, Ohio. Following the NS line, the park boundary extends east-northeast 545.97 feet, then north 202.73 feet, and east 2,428.57 feet to Clare Road. From Clare Road, the park boundary extends northwest to Harvard Street 2,464.65 feet, then west on Mariemont Avenue 706.66 feet to the swimming pool parking lot. The park boundary then extends eastward back 748.53 feet to the first private residence, then northwest 355.74 feet along the private residence property line. Following the private property parcel markings, the park boundary goes east 342.94 feet. It continues north 120.83 feet along the private property parcel line and east 384.64 feet along the private property parcel line, and south on the eastern private property parcel line 196.84 feet to Mariemont Avenue. The park boundary then extends east along Mariemont Avenue to the intersection Pleasant Street 1,063.89 feet from the intersection, the park boundary extends north along Pleasant Street to US 50 for 977.91 feet from the intersection of Pleasant Street and US 50, the park boundary extends west to Park Avenue for 1,219.84 feet.
      (3)   Dogwood Park is established and constituted as a forest, bird, and wildlife preserve and sanctuary.
   (B)   No person shall take, hunt, trap, kill, or pursue, or be in possession of any wild animal or wild fowl in Dogwood Park, or be in possession outside such land of any wild animal or wild fowl taken therefrom, except as provided by law. This provision shall not prevent any peace officer, game warden, or any officer lawfully exercising the functions of peace officers or game wardens from killing or pursuing any wild animal therein, in the performance of the duties of such officers.
   (C)   No person shall enter Dogwood Park with intent to cut timber growing therein, or otherwise commit waste.
   (D)   No person shall enter Dogwood Park while in possession of any gun or other firearm, explosive air rifle, sling shot, net, snare, trap of any description, axe or sheath knife, or any cutting instruments other than pocket knives; however, any peace officer or game warden may enter the park while carrying firearms on duty. This provision shall not prevent village maintenance persons from cutting any timber growing in the park in connection with maintenance work.
