§ 53.03 USE OF SPACE UNDER SIDEWALKS.
   With the approval of the Building Commissioner, any property owner may be permitted, in connection with an existing or proposed improvement on his or her property, to utilize space abutting his or her property under a street sidewalk as far as the vertical plane parallel with, and three feet from, the vertical plane of the curb line. The private use of sidewalk space shall in every case be subordinate to the village’s use of the same for public purposes, including lawful use by public utility corporations, and shall at all times be subject to modification or control by the village and to termination or revocation as set forth in § 53.10.
