§ 51.18 CONDOMINIUM ASSOCIATIONS WAIVER FOR VILLAGE TRASH SERVICE.
   (A)   All legally recognized condominium associations within the village who contract for their own trash services directly shall be allowed to apply for a waiver of the village trash services and the related fees.
   (B)   Said application for such waiver shall be submitted as follows.
      (1)   The waiver must be a written request and it must be accompanied by written proof of the valid existence of the condominium association and written proof of the trash service contract already in effect which would include a request for both trash and recycling services.
      (2)   Said request shall be reviewed and approved or disapproved by a majority of Village Council members. Any such waiver that previously has been granted by Village Council may be revoked at any time Council determines that the condominium association’s trash service is not equal to or greater than the village contracted services.
      (3)   Any trash service payments which have been paid by valid condominium association members, once a waiver is granted, shall be refunded.
   (C)   This section shall take effect at the earliest date allowed by law.
