§ 153.167 OPEN SPACE.
   (A)   (1)   At least 20% of the gross land area shall be designated as open space.
      (2)   Submerged lands may not be included as a part of this open space requirement.
      (3)   A complete legal description of the open space area shall be submitted along with a sketch showing natural features such as woodlots, vegetation, historical sites, streams and the like.
   (B)   The plan shall include a proposal for the development and maintenance of the open space areas.
      (1)   A homeowner's association to which the land is deeded is the preferred method.
      (2)   If an alternative method is proposed, issues such as maintenance, taxation and regulation of the open space area shall be discussed.
      (3)   Adequate guarantees, as permitted in § 153.137, for its development shall be submitted to the Commission prior to obtaining the necessary signatures.
