§ 91.06 TREES, PLANTS, SHRUBBERY AND WEEDS.
   (A)   The owner of every lot or parcel of land within the village upon which a tree, plant or shrubbery stands with any part thereof upon or overhanging a public street or sidewalk or has a tree, plant or shrubbery standing in the street adjoining his or her lot or parcel, shall conform to the regulations herein provided; otherwise, the village shall cause the trees to be trimmed or cut down and removed in accordance with the regulations and assess the cost thereof against the owner of the lot or parcel of land.
   (B)   (1)   The owner shall trim or cause to be trimmed the tree, plant or shrubbery so that a clear height of eight feet between the lowest branches of the same and the street or sidewalk is maintained.
      (2)   The owner shall trim or remove, as the case may require, every dead, decayed or broken tree, plant or shrubbery, or part thereof, so that the same shall not fall to the street or sidewalk.
      (3)   The owner shall cut down and remove any tree, plant or shrubbery, or any part thereof as may be necessary to provide a clear and unobstructed view of traffic from all directions at any street intersection, or to abate any nuisance necessary to protect life, limb or property of persons, drivers of any vehicle, or pedestrians using the street or sidewalk.
      (4)   It shall be unlawful to plant or replace trees of any species on any part of a dedicated street without first obtaining permission of the Village Council.
   (C)   In the event the owner does not trim or remove any weeds, trees, plants or shrubbery, or any part thereof, in accordance with the provisions of this section, then the Chief of Police shall issue a notice in writing to the owner to comply with the provisions in this section within ten days of the date of the notice and upon noncompliance therewith, the Chief of Police is hereby authorized and it is hereby declared to be his or her duty to have enforced the provisions of this section and to cause to be trimmed or removed the tree, plant, shrubbery or part thereof, and cut and remove all grass and weeds.
   (D)   The owner, occupant or person having charge or management of any lot or parcel of land situated within the corporate limits of the village, whether the same be improved or unimproved, vacant or occupied, shall cut or destroy or cause to be cut or destroyed any weeds growing upon any lot, or parcel of land, and prevent the same from blooming or going to seed or exceeding a height of six inches.
   (E)   Whenever any tree, plant or shrubbery, or part thereof, or weeds and grass are growing in any street, public place, or upon private property contiguous to a street or sidewalk, or public place, and is trimmed or removed by the village, then, after the work is done, the village shall give five days notice, by regular mail, to the owner of the lot or parcel of land, at his or her last known address, or best obtainable address, to pay the costs of the trimming or removal of trees, plants, shrubbery, grass or weeds, or parts thereof, which the notice shall be accompanied by a statement of the amount of cost incurred, and in the event the same is not paid within 30 days after the mailing of the notice, then the amount to be certified to the County Auditor for collection of the same as other taxes and assessments are collected.
