§ 35.05 POST INCIDENT TESTING.
   (A)   Post incident testing. Post incident testing is indicated for any employee who:
      (1)   May have caused or contributed to an on-the-job incident that causes $2,000 or more damage;
      (2)   Caused or involved in an OSHA recordable incident at any Marblehead Village work site;
      (3)   Is involved in any traffic incident while operating a village vehicle which may have caused or contributed to an accident, which involves a citation, and causes $2,000 or more damage at any time day or night; or
      (4)   Is cited for driving while intoxicated operating village vehicles or equipment.
   (B)   Follow-up to treatment of assessment.
      (1)   When an employee has tested positive and/or has received treatment or assessment under this program, a minimum of two tests or maximum of four tests in the first year from the date of the employee's return to duty will be administered.
      (2)   The first test will serve as a return to duty test and occur before an employee resumes work activities.
      (3)   The others will be done randomly throughout the year.
   (C)   Confidentiality.
      (1)   Test results and other information concerning substance investigations will be treated confidentially.
      (2)   Test results and other documents relating to investigations and/or rehabilitative treatment will be kept separate from other personnel records.
