A. The purpose of this section is to provide for the delivery of irrigation water stock and the amount thereof to the city as a requirement for issuance of a building permit and to provide penalties for the violation thereof, so as to promote the health, safety and general welfare of the city and to these ends to provide for the orderly development of the area and to provide municipal water and other facilities.
B. No permit shall be granted for the erection and construction of any building or other structures for which a permit is required where culinary water will be used under the building code of the city, or a school or church unless the person or applicant applying for the permit shall first convey to the city irrigation water stock based on the percent of the lot using culinary water and irrigation water. This conveyance to the city is in consideration of the city providing culinary water to the property.
The determination of the equivalent of water irrigation stock in different water companies shall be based on the amount of irrigation stock supplying water to the particular land over the last five (5) years to the given area where the building is to be erected and constructed.
C. Any firm, corporation, person or persons violating any of the provisions of this section shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in any sum less than two hundred ninety nine dollars ($299.00) or by imprisonment for any term not exceeding six (6) months or by both such fine and imprisonment.
