§ 95.07  IMPOUNDING.
   (A)   Police to impound.
      (1)   Any dog found unlicensed or any dog or cat running at large contrary to the provisions of this chapter might be impounded by an Animal Control Officer or any Police Officer, who shall give notice of the impounding to the owner of the dog or cat, if known.
      (2)   If the owner is unknown, the Officer shall post notice in 3 conspicuous places in the city stating that if the dog or cat is not claimed within 5 days of the posting of the dog notice it will be disposed of and the owner shall bear the cost of the disposal. Cats may be caught by use of a live trap.
   (B)   Redemption. The owner may redeem any dog or cat from the veterinary clinic selected by City Council within the time stated in the notice by the payment of the following fees:
      (1)   An impounding fee in the amount set by the designated veterinary clinic; and
      (2)   A license fee, if unpaid.
   (C)   Disposition of unclaimed dogs and cats.
      (1)   Any dog or cat which is not redeemed within the time specified in division (B) above may be sold for not less than the amount provided in that division to anyone desiring to purchase the dog or cat, if it is not requested by a licensed educational or scientific institution under M.S. § 35.71, as it may be amended from time to time.
      (2)   All sums received in excess of the fees fixed by division (B) above shall be paid to the owner if he or she makes a claim within 1 year of the sale and furnishes satisfactory proof of ownership.
   (D)   Animal Control Officer. The Animal Control Officer shall be appointed by the Council. He or she shall perform other duties imposed on him or her by this chapter.
   (E)   Violation. Any person violating the provisions of this chapter shall be guilty of a misdemeanor.
